Interesting situation.

To avoid this discussion being closed, let's discuss the principles behind this situation and leave the names out of it. The last thing we need is any legal issues with slander and libel.

That being said, isn't a legal document binding, mistake or not? If you trade your car at waaay to low a price, you can't just call a dealer up and say you changed your mind. A deal is a deal, loss or no loss, right?

yes

or so it was thought.

i wonder if this will open the doors to trades took back (like you hinted at).

if the buyer got 'took' for 10k on his trade, he sure could not take the deal back.... unless it was in alabama. you can back out of any business deal within 3 business days.

and its only slander and libel if its known not to be true...

rainmans 'k-mart sucks' comes to mind.

I don't think a dealer will win in a case like this. And if they do, it will definitely set a precedent allowing individuals to back out too. And boy, what will that do for the legality of the sales contracts?

And that's up to a court to decide, which would cost money right or wrong, because of the attorney fees involved. We've had this discussion before. The rules are here to protect both the site visitors and HCS. And this is the last time I'm going to make this point.

will wager Bill Heard will win... there was a material mistake made that both the buyer and seller should have been aware of. Most all contracts with dealers today have arbitration clauses.... the buyer may have had a shot in court... no chane in arbitration. Buyer should have taken the $500 offered and called it a day...

That's true. I never thought of that.

That's why I always read every word of every legal document I sign. Even if it's just a "standard contract", then you at least know what you're getting into.

You know that they have themselves covered or the DA would have not said this is a Civil matter. This story is all over the Internet, with many actual stories about other bad dealings people had with said very large car dealer. I have already heard enough of these stories here in town to know that I would never go there. Just listen to their commercials and you can see they are trying to put people in cars they can't afford. Probably even have their own Repo staff.
Just one more example of why the big 3 are having trouble.
